This Employee Candidate Data Protection Statement ("Statement") explains our commitment to keep your personal data ("Employee Candidate Data") confidential and secure at all times and provides information on our personal data processing practices in business activities related to recruitment ("Recruitment"). This Statement covers also Employee Candidate Data processing in our online recruitment tools utilized as part of Recruitment e.g. to publish job advertisements and to receive job applications.

Your Employee Candidate Data is processed in accordance with all applicable laws and regulations.

In case of possible discrepancy, the information provided in the Description prevails the information presented in this Statement.

Please read this Statement carefully prior to participating in Recruitment. By participating in Recruitment and/or by submitting (directly or indirectly), your Employee Candidate Data to us in connection with Recruitment, you express your understanding of the processing of your Employee Candidate Data in the manner provided in this Statement. Otherwise, we expect that you will immediately discontinue participating in the Recruitment and will not provide or will cease providing us with your Employee Candidate Data. However, please note that the absence of your Employee Candidate Data might prevent full consideration of your application in the Recruitment.

Your Consent

Your consent to us to use and process your Employee Candidate Data allows 1) collection (also from any third parties or third-party sources relevant for Recruitment as the case may require) and 2) processing of all Employee Candidate Data obtained in connection to the Recruitment for the purposes defined in this Statement and in the Description. You give this consent to us by providing us with your Employee Candidate Data either by continuing the use of the online recruitment tool or by contacting us by other means, (e.g. e-mail or letter).

Your consent also explicitly covers collection and processing of Sensitive Employee Candidate Data (as described below), as the case may require.

Please note also, that if you provide us with any Sensitive Employee Candidate Data (e.g., by enclosing your photo or any health information as part of your application or curriculum vitae) not specifically requested by us, you will be deemed to have provided us with your separate explicit consent for Sensitive Employee Candidate data processing for the purposes described in this Statement.

You have the right to withdraw your consent at any time. To do so, please contact us with the contact information provided below in this Statement, in the job advertisement or in the Description.

Please note that the withdrawal of your consent will immediately prevent us from taking you into account in the Recruitment.

Our Data Collection Methods

Participating in the Recruitment requires you to personally provide us with certain Employee Candidate Data. Besides the utilization of online (or otherwise computerized) data collection methods, depending on the Recruitment, we may also collect all or certain Employee Candidate Data from you (e.g. in a phone call, job interview or with other means common in recruitment).

In addition to collecting Employee Candidate Data from you personally, we may collect your Employee Candidate Data also from any public sources, third parties, our own employees and/or other persons providing services for us. By providing us your consent as mentioned above, you consent to such data collection from these sources.

The Data We Collect and Process

Basic Employee Candidate Data typically collected by us consists generally of your name, contact details, work experience, education, skills, references, interests, curriculum vitae and cover letter. When providing us with information about a third-party individual (such as references), you are responsible for ensuring that you have attained all such third-party consent possibly required for providing us with the information, as stipulated by the law. You are also to provide such third parties with this Statement and Description, to inform them of the processing of their personal data as part of the Recruitment, including their right to withdraw the data processing consent, as explained above.

In addition, we may collect other types of Employee Candidate Data that is generally necessary for the Recruitment. Detailed information concerning the type and processing of Employee Candidate Data is available in the Description.

We do not generally collect any Employee Candidate Data belonging to special categories ("Sensitive Employee Candidate Data"), such as personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership or data concerning health or sex life. However, as the case may be, we may occasionally need to collect some Sensitive Employee Candidate Data about you, if it is necessary to ensure the compliance with any mandatory legal requirement in any applicable legislation or, as the case may require, to assess your suitability as part of the Recruitment.

Furthermore, if you participate in the Recruitment electronically via our online tool, we may automatically track certain personal data concerning you, such as the IP address, the source of visit, and the type of your web browser, prior to explicitly requesting any of your Employee Candidate Data described above.

Generally, we retain your Employee Candidate Data no longer than twelve (12) months from the:

·      Recruitment decision (in case of a specific job opening); or

·      Collection of Employee Candidate Data (in case of an open job application);

This 12-month period ("General Retention Period") is typical, unless otherwise required or allowed by:

·      Any applicable legislation (cf. Annexes of this Statement); or

·      Your consent.

Moreover, we may always extend the retention of Employee Candidate Data on the grounds of establishment, exercise or defense of legal claims or execution of our internal investigations as the case may require.

The Purposes of Processing

We process your Employee Candidate Data mainly in connection with our recruitment processes, including receiving applications, job interviews, personal assessments, background checks (possibly conducted by external service providers), and any other actions necessary for the conclusion of the Recruitment. Therefore, the primary purpose of processing of your Employee Candidate Data is

·      Fulfilling our job openings.

We may also process Employee Candidate Data for the following purposes:

·      Reporting and analytics;

·      IT system and process development;

·      Ensuring your and our rights and our compliance with legislation applicable to the Recruitment.

Employee Candidate Data will not be used for direct marketing or for any other purpose than those described above in this Statement and in the Description.

Lawfulness of Processing of Employee Candidate Data

Processing Employee Candidate Data by us is based on:

·      Consent(s) received from you and third parties (as may be required by the law); and

·      Obligations and rights of the data controllers based on mandatory laws, including but not limited to, labor, data protection and non-discrimination laws, as well as penal codes.

Disclosures and Transfers of Employee Candidate Data

We do not generally disclose any Employee Candidate Data to be independently used by other data controllers outside us or companies belonging to same group of companies with us, unless required by the law.

We may transfer your Employee Candidate Data within companies belonging to same group of companies with us or to third parties (e.g. subcontractors) who process Employee Candidate Data for us for the purposes described in this Statement and in the Description. In this way, we do not release the Employee Candidate Data from our effective control.

As we operate globally, due to technical and practical requirements, your Employee Candidate Data may be processed by companies belonging to same group of companies with us or subcontractors located outside the European Union or European Economic Area (incl. Switzerland). Therefore, countries to which your personal information may be sent/accessed from may have a different standard of data protection than the country in which you are situated. However, in all such cases, the processing of Employee Candidate Data shall be in accordance with applicable legislations (e.g. justified by EU Commission standard contractual clauses) and our data processing policies and instructions.

We may also share your Employee Candidate Data with a purchaser or potential purchaser of our business – in such a case we will only share only smallest possible amount of information and within in the limits of applicable legislation.

We may provide aggregate statistics about our employee candidates and the Recruitment to reputable third parties, but these statistics are anonymized and will not include your Employee Candidate Data.

Security

Unfortunately, the transmission of information via the internet is not completely secure. We cannot fully guarantee the security of your Employee Candidate Data transmitted to us; any such transmission is therefore at your own risk. Once we have received your information, we will use strict procedures and security features to prevent unauthorized and illegal access, alteration and denial of use of your Employee Candidate Data.

Use of Cookies

From time to time, we may place information on your computer which allows us to recognize your computer. This information is commonly known as a “cookie”. Typically, cookies enable collection of certain information regarding your computer, including your internet protocol (IP) address, your computer’s operating system, your browser type and the address of any referring sites. Cookies are intended to improve availability and quality of the Recruitment. A separate Cookie Statement explains the cookies in detail (references to Statement above and below include also the contents of the Cookie Statement unless otherwise stated case by case). In case of possible discrepancy, the information provided in the Cookie Statement prevails over information of this Statement and the Description.

Your Rights

At any time, you have the right to:

·      Gain access to your Employee Candidate Data;
 
·      Verify the accuracy of your Employee Candidate Data;

·      At your request, have your incomplete, inaccurate or outdated Employee Candidate Data modified or erased;

·      Under certain circumstances, be forgotten by us;

·      Under certain circumstances, restrict the processing of your Employee Candidate Data;

·      Receive the Employee Candidate Data which you provided to us in a structured, commonly used and machine-readable format and have the right to transmit those data to another data controller; and

·      Lodge a complaint with a supervisory authority.

Also, at any time, you have the right to:

·      Withdraw your consent to processing of your Employee Candidate Data.

Please note that the withdrawal of your consent will immediately prevent us from taking you into account in the Recruitment.

If you follow a link to any of these websites, please note that these websites are separate from our websites and do not operate under this Statement or any other data protection practices of us. These sites have their own privacy policies, data protection statements or similar announcements. We do not accept any responsibility or liability for these policies, statements and announcements or the lack of them or your use of such websites. Please check these policies, statements and/or any other data protection documents before you submit any Employee Candidate Data to these websites.

Changes to This Statement

From time to time, we may change or amend this Statement. In addition, we may modify or revoke access to the Recruitment at any time with or without notice. It is the recommendation of us that you revisit this Statement periodically to review any changes to this Statement.

·      Konecranes Global Corporation with Finnish Business ID 2711339-8, having special responsibility in Konecranes Group for centralized IT resources and international personal data transfers;
 

as well as all other companies belonging to Konecranes group of companies (also “Konecranes”, “we”, "us", "our" in this Statement) and acting as data processors place the highest priority on protecting the integrity of your personal data.

Konecranes does not guarantee employment for any employee candidate. The published job advertisements do not under any circumstances set a commitment to establish employment. ·      Instead of General Retention Period, the retention period applicable to all Employee Candidate Data and to all purposes of uses is twenty-four (24) months starting from the Recruitment decision, in case of a specific job opening, or from the collection of Employee Candidate Data, in case of an open job application.

 

Annex for Finland:

Effective date: 9 October 2017

This Annex serves as a supplement to the Konecranes Employee Candidate Data Protection Statement and contains additional/amending provisions based on the laws of Finland.

·      In addition to General Retention Period, the retention period of all Employee Candidate Data, for the purpose of use of fulfilling of employer duties as well as rights of employee candidates and employer, (including but not limited to those related to non-discrimination or criminal processes) is twenty-four (24) months.

·      In some occasions, related to specific job openings and in accordance with the applicable laws, we may need to collect and process Employee Candidate Data intended to establish your reliability, such as your personal credit information.

·      In some occasions, related to specific job openings and in accordance with the applicable laws, we may have to receive your drug test certificate or results of your personality and /or aptitude assessment tests. In these cases, you will be provided with detailed prior information and a separate explicit consent will be asked from you.

 

Annex for Germany:

Effective date: 9 October 2017

This Annex serves as a supplement to the Konecranes Employee Candidate Data Protection Statement and contains additional/amending provisions based on the laws of Germany.

·      Instead of General Retention Period, the retention period applicable to all Employee Candidate Data and to all purposes of uses is six (6) months starting from the Recruitment decision, in case of a specific job opening, or from the collection of Employee Candidate Data, in case of an open job application.

 

Annex for the United States:

Effective date: 9 October 2017

This Annex serves as a supplement to the Konecranes Employee Candidate Data Protection Statement and contains additional/amending provisions based on the laws of the United States.

·      Instead of General Retention Period, the retention period applicable to all Employee Candidate Data and to all purposes of uses is thirty-six (36) months starting from the Recruitment decision, in case of a specific job opening, or from the collection of Employee Candidate Data, in case of an open job application.
